If there is any conflict:

Payment and Related Information

At present Welde Engineering Solutions Pvt. Ltd is not charging any browsing fees for using its platform and Welde Engineering Solutions Pvt. Ltd collects all the payments from its customers in relation with buying and selling products/services in its platform. Such payments later distributed to the respective sellers after deducting the particular commission charged by Welde Engineering Solutions Pvt. Ltd. For buying products/services here in this platform customers can either make the complete payment in advance as online or they can pay  on delivery.

You agree to provide correct and accurate financial information, such as credit/debit card details to the approved payment gateway or pre-paid payment instrument account details for availing Services on the Website. You shall not use the credit/debit card or pre-paid payment instrument which is not lawfully owned by you, i.e. in any transaction, you must use your own credit/debit card or pre-paid instrument account. For Your making payments for buying the Products on the Website, in addition to the Agreement(s), the terms and conditions of your bank, applicable financial institution and/or card issuing association may also be applicable to you. Your bank, financial institution or card issuing association may decline or prevent you from making electronic payments for buying the Products on Website and Welde Engineering Solutions Pvt. Ltd does not control the same and shall be liable for the same.

Cancellation, Return, Replacement & Refund

Cancellation of orders shall be ensured before the shipment. Any attempt for cancellation post this specified time period cannot be considered. Cancellation of orders can be done through any of the medium available with; https://www.weldeengineering.com/contact 

Cancellation of orders on or after shipment or return without proper reasons shall attract a fine of cost of shipping charge incurred by the supplier per the consignment and your refund after deducting the fine should be made within 10 working days. And it is the responsibility of the customer to return such consignment properly to the supplier.

For detecting any product damage upon delivery customer should inform Welde Engineering Solutions Pvt. Ltd within one day for replacement. There shall be a replacement of product ensured post 7 days after checking the quality of returned product. There shall not be any fine levied on customer if his claim is genuine

Upon returning the consignment customer should ensure exact items delivered with that package no any replacement or any other fraudulent activities shall not be permitted, any breach of this condition may bring legal proceedings between the related parties.

Delivery Terms

Welde Engineering Solutions Pvt. Ltd shall not be responsible for any damage caused and delivery lapse of the products by the sellers.

Deciding and keeping the delivery time and proper delivery according to the promise made in the offer is the sole responsibility of the sellers and Welde Engineering Solutions Pvt. Ltd does not bear any responsibility on this

There shall be a penalty of shipping cost from the customer in case of a delivery failure due to the inappropriate credentials given by the customers.

User Obligation and Role of Welde Engineering Solutions Pvt. Ltd

Subject to compliance with the Agreement(s), Welde Engineering Solutions Pvt. Ltd grants you a non-exclusive, non-sub-licensable, non-transferable, revocable, and limited right to access and use this Website and the Services provided therein.

b. Multiple orders placed for same product at the same address; 

c. Bulk quantity of the same product ordered;

There may be certain orders that Welde Engineering Solutions Pvt. Ltd is unable to process or pass on buyer's order to the seller and must cancel. Some situations that may result in Welde Engineering Solutions Pvt. Ltd inability to process or pass on buyer's order to the seller include, without limitation, non- availability of the Website service, force majeure, credit limitations or suspected fraud.

In case buyer purchases multiple Products in one transaction, the Seller(s) may deliver all such Products together (if all products are bought from a single seller otherwise it will be processed and dispatched differently). Ltd entire and aggregate liability to You under and in relation to these Terms of Use or otherwise shall not exceed the greater of Indian Rupees One Hundred (INR 100) or the amount of fees, if any, paid by You to Welde Engineering Solutions Pvt. Ltd under the relevant order to which the cause of action for the liability relates.

Notwithstanding anything to contrary in the Agreement(s), in no event shall Welde Engineering Solutions Pvt. Ltd, its subsidiaries or affiliates and their respective officers, directors, employees, partners or suppliers be liable to You for any special, incidental, indirect, consequential, exemplary or punitive damages whatsoever, including those resulting from loss of use, data or profits, whether or not foreseeable or whether or not Welde Engineering Solutions Pvt. Ltd has been advised of the possibility of such damages, or based on any theory of liability, including breach of contract or warranty, negligence or other tortious action, or any other claim arising out of or in connection with Your use of or access to the Website, Services or Content.

 Terms

The Agreement will continue to apply until terminated by either you or Welde Engineering Solutions Pvt. Ltd as set forth below. If You want to terminate Your agreement with Welde Engineering Solutions Pvt. Ltd, You may do so by (i) not accessing the Website; or (ii) closing Your Account for all of the Services that You use, where Welde Engineering Solutions Pvt. Ltd has made this option available to You.

You agree that Welde Engineering Solutions Pvt. • The provision of the Services to you by Welde Engineering Solutions Pvt. Ltd is, in Welde Engineering Solutions Pvt. Ltd opinion, no longer commercially viable;

• Welde Engineering Solutions Pvt. Ltd has elected to discontinue, with or without reason, access to the Website, the Services (or any part thereof); or

Governing Law & Jurisdiction 

These Terms of Use and all transactions entered into on or through the Website and the relationship between you and Welde Engineering Solutions Pvt. Ltd shall be governed in accordance with the laws of India without reference to conflict of laws principles.

The customer shall agree that any disputes or difference arising under or in relation with the transactions or activities or any policies of this site shall be subject to the exclusive jurisdiction of the Courts/Forum at Kochi, Kerala state and customer here by accede to and accept the jurisdiction of such courts/forum

Ltd may inform you of such assignment or transfer in accordance with the notice requirements under the Agreement. Welde Engineering Solutions Pvt. Ltd shall have right to transfer your Account and Account Information to a third party who purchases Welde Engineering Solutions Pvt. Ltd business as conducted under the Website.

Severability: If, for any reason, a court of competent jurisdiction finds any provision of the Agreement, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of the parties as reflected by that provision, and the remainder of the Agreement shall continue in full force and effect. Welde Engineering Solutions Pvt. Ltd are independent contractors, and nothing in these Terms of Use will be construed to create a partnership, joint venture, association of persons, agency (disclosed or undisclosed), franchise, sales representative, or employment relationship between You and Welde Engineering Solutions Pvt. Ltd. As an abundant caution, it is clarified that Welde Engineering Solutions Pvt. Ltd shall not have any right to conclude any contract for sale or purchase of Products for and / or on your behalf and both you and Welde Engineering Solutions Pvt. Ltd have entered this agreement on principal to principal basis.

Force Majeure: If performance of any service or obligation under these Terms of Use or other Agreement by Welde Engineering Solutions Pvt. Ltd is, or other third parties in fulfilment of any purchase or sale transaction (for e.g.: logistics service provider, fulfilment centre, payment gateways etc.) are, prevented, restricted, delayed or interfered with by reason of labour disputes, strikes, acts of God, floods, lightning, severe weather, shortages of materials, rationing, utility or communication failures, earthquakes, war, revolution, acts of terrorism, civil commotion, acts of public enemies, blockade, embargo or any law, order, proclamation, regulation, ordinance, demand or requirement having legal effect of any government or any judicial authority or representative of any such government, or any other act whatsoever, whether similar or dissimilar to those referred to in this clause, which are beyond the reasonable control of Welde Engineering Solutions Pvt. Ltd or its third parties performing such services as sub-contractor to Welde Engineering Solutions Pvt. Ltd and could not have been prevented by reasonable precautions (each, a "Force Majeure Event"), then Welde Engineering Solutions Pvt. Ltd shall be excused from such performance to the extent of and during the period of such Force Majeure Event. Welde Engineering Solutions Pvt. Ltd shall exercise all reasonable commercial efforts to continue to perform its obligations hereunder.
